The Delhi High Court has allowed Hindustan Unilever’s (HUL) Lakmé to proceed with its "Sun Superiority Campaign" after making certain modifications. This follows a legal challenge by Honasa Consumer Ltd., the parent company of Mamaearth, accusing Lakmé of misleading advertising.
The controversy revolves around Lakmé’s "SPF Lie Detector Test" campaign, which questioned the SPF 50 claims of certain online-only brands. Mamaearth claimed the campaign indirectly targeted its subsidiary, The Derma Co., implying their sunscreens did not meet advertised SPF standards. Mamaearth also accused Lakmé of copying The Derma Co.'s packaging, potentially confusing consumers.
While the court found the ad potentially disparaging, it allowed Lakmé to modify it instead of issuing an injunction. In return, Mamaearth agreed to remove its critical social media posts. Both companies aim to resolve the dispute amicably, focusing on consumer trust and safety.
Lakmé reaffirmed its commitment to accurate SPF testing, while Mamaearth continues to advocate for transparency and innovation in the skincare industry.
